Privacy Policy – Suppliers – pursuant to Article 13 of Italian Legislative Decree no. 196 of 30 June 2003 concerning the protection of supplier personal data

Please be informed that Legislative Decree no. 196 of 30 June 2003 (“Privacy Law”) protects people and other subjects in relation to the processing of their personal data. According to this decree, your data will be processed in accordance with principles of correctness, lawfulness, transparency and protection of your privacy and personal rights.

According to section13 of Legislative Decree no. 196/2003, we inform you that:

  1. The purpose for processing your data is to:
  • comply with legal and EU obligations
  • fulfill contractual obligations
  • send information or commercial proposals (mail, fax, e-mail)
  1. Personal data is processed using paper and/or digital means, by telephone and electronic means, in compliance with laws on security and confidentiality
  2. Data must be provided so that contracts can be concluded and executed and to satisfy any requests by the data subject (technical or commercial information, etc.). Failure to provide those data may result in the partial or non-execution of the contract and termination of the relationship.
  3. The data may be forwarded to third parties if required to fulfill obligations of law or the contract in force between the parties (e.g. public entities, supervisory authorities, banks, etc.).

  4. At any time you may exercise your rights with the processing controller as set forth in Article 7 of Legislative Decree 196/2003, as indicated below for your convenience:

Legislative Decree no. 196/2003, Article. 7 – Right of access to personal data and other rights

  1. Data subjects shall have the right to obtain confirmation as to whether or not personal data concerning them exist, even if the data have not yet been recorded, and communication of such data in intelligible form.
  2. Data subjects shall have the right to information on:
    a) the source of the personal data;
    b) the purposes and modes of processing;
    c) the logic applied when the data is processed with the use of electronic instruments;
    d) the identity of the data controller, data processing officers and the representative designated pursuant to Article 5.2;
    e) the parties or categories of parties to which the personal data may be transferred or which may gain knowledge of them as designated representatives of the State, processing officers, or processors.
  3. Data subjects shall have the right to obtain:
    a) the updating, correction or, when they are interested, additions to the data;
    b) the cancellation, transformation into anonymous form, or blocking of data processed in violation of law, including those that need not be retained for the purposes for which the data were collected or subsequently processed;
    c) certification that the parties to which the data have been transferred or disseminated have been notified of the operations specified in points a) and b), also regarding their content, except for the case where notification proves impossible or requires the use of means clearly disproportionate to the right being protected.
  4. Data subjects shall have the right to oppose, wholly or in part:
    a) for legitimate reasons the processing of their personal even when it pertains to the purpose of collection;
    b) the processing of their personal data for the purpose of sending advertising or direct marketing material or to conduct market research or commercial communication surveys.

Policy on the treatment of customer data as set forth in Article 13 of the Privacy Law (Legislative Decree 196/2003)

Maspero Elevatori S.p.A. will process the personal data provided by customers during contract negotiations or execution of the contract (a) for purposes of fulfilling the contract, (b) to comply with legal obligations, (c) to provide promotional information or advertising by telephone, mail, fax and e-mail relating to activities or initiatives of Maspero Elevatori or other group companies, and (d) to record and analyze customers’ attitudes and preferences of use or consumption and measure their degree of satisfaction. Processing ma consist of collection, analysis, recording, comparison, communication and archiving of customers’ personal data both manually and by digital and/or automated means.

Maspero Elevatori may transmit the personal data to the following categories of parties, for the purposes indicated above: (i) other companies of the Maspero Elevatori group; (ii) third parties engaged to perform related activities necessary to supply the products and/or provide the services for which Maspero Elevatori has concluded commercial agreements; and (iii) third parties to fulfill the obligations of law or the contract (e.g. public entities, supervisory authorities, banks, etc.).

The data will not be publicly released and may be transferred abroad to other companies of the Maspero Elevatori group in conformity with articles 43 and 44 of Legislative Decree 196/2003. The provision of data by the customer for the purposes of letter b) is obligatory, while for the purposes of letters a), c) and ) it is optional. Refusal to provide the aforesaid data for purposes a), c) and d), however, may make it impossible for Maspero Elevatori to execute all or part of the contract and in any case to utilize the data for said purposes. Customer consent to processing for the purposes of a) and b) is not necessary pursuant to Article 24 a) and b) of Legislative Decree. As the data subjects, customers shall have the rights specified in Article 7 of Legislative Decree 196/2003, including the right to obtain confirmation from the controller as to whether or not personal data concerning them exist and communication of such data in intelligible form, the identity of the data controller and the parties to which the data may be transmitted, to obtain the updating, correction or cancellation of the data, their transformation into anonymous form or the blocking of data processed in violation of law, as well as to oppose their processing for legitimate reasons.
